Featured Guest Agreement | Real Estate Moguls
Last updated: June 5, 2026
This Featured Guest Agreement establishes the terms under which a Featured Guest participates in a recording session produced by Real Estate Moguls. It is presented to the Featured Guest before any scheduling occurs, signed at the point of scheduling, and stored as part of the production record. The acceptance workflow described in Section 2 is the sole method by which this Agreement becomes binding.
1. Definitions
Featured Guest. The professional booking a recording session with Real Estate Moguls. References to “you” and “your” mean the Featured Guest.
Real Estate Moguls. The platform operator, including its parent companies, subsidiaries, affiliates, owners, officers, producers, hosts, employees, contractors, agents, sponsors, advertisers, and assigns. References to “we,” “us,” and “our” mean Real Estate Moguls.
Production Session. The on-camera recording session at the production facility designated by Real Estate Moguls, including any pre-interview, walk-throughs, hair and makeup, principal recording, B-roll capture, and any additional photography or audio capture associated with the session.
Episode. The edited audio, video, written, and graphic content produced from the Production Session, in any form Real Estate Moguls releases now or in the future, including clips, excerpts, derivative works, social media assets, and archival materials.
Released Parties. Real Estate Moguls and all of the persons and entities included in the definition of “Real Estate Moguls” above.
2. Acceptance and Signing Workflow
This Agreement becomes binding only through the following acceptance process. Booking the initial call without completing this process does not, by itself, constitute acceptance.
- The Featured Guest is presented with a link to this Agreement before any scheduling is confirmed, and the link is emailed after the scheduling page.
- The Featured Guest checks a box affirmatively stating, “I have read, understand, and agree to the Real Estate Moguls Featured Guest Agreement.”
- The Featured Guest enters their full legal name and electronic signature, and the system records the timestamp, IP address, email address, as a digital signature of the agreement as presented.
Completing this workflow is the sole method by which this Agreement is accepted. The Featured Guest agrees that this electronic acceptance has the same legal force and effect as a handwritten signature on a printed copy.
3. Production Commitment
By completing the acceptance workflow in Section 2 and confirming a scheduling slot, you commit to attending the Production Session on the date and time confirmed in writing by our producer. You arrive at the time confirmed in your booking, ready to record. You give us at least seventy-two hours of notice if you need to reschedule, except in cases of documented medical emergency or immediate family bereavement. We hold one rescheduling slot per Featured Guest at our discretion. No-shows without notice forfeit the booking entirely, and we may decline future bookings.
The Production Session is the single most expensive thing we do for any guest. Holding the studio, crew, host, and creative team for someone who does not appear is a real cost we cannot recover. This commitment exists because we treat your time with the same seriousness, and we ask you to do the same with ours.
4. Content, Likeness, and Commercial Use Release
You grant Real Estate Moguls a perpetual, worldwide, royalty-free, transferable, sublicensable right to record, edit, reproduce, distribute, publish, broadcast, syndicate, repurpose, promote, archive, and otherwise use your name, voice, likeness, image, photograph, biography, statements, professional credentials, and any contributions you make during the Production Session, in any media now known or later developed, including audio, video, written, podcast, social, editorial, and emerging formats.
You expressly consent to the use of your identity for advertising, marketing, promotion, sponsorship sales, membership sales, paid advertising, organic social media, sales presentations, investor materials, email marketing, website materials, conference materials, event marketing, and any other commercial promotion of Real Estate Moguls and its affiliates, sponsors, advertisers, and business partners.
This release covers the full Episode, all clips and excerpts, all promotional material, all derivative works, all archival uses, and any modified or adapted versions for length, format, or channel. You waive any right to inspect, approve, or restrict the final edit, and you understand that Real Estate Moguls makes all editorial decisions about what appears in the released Episode.
You confirm that the statements you make are your own, that any third-party material you reference is properly attributed, that nothing you say or share infringes on anyone else’s rights, and that you hold all rights necessary to grant the consents in this Section.
5. Sponsor and Advertiser Adjacency
You acknowledge that Real Estate Moguls operates a media platform supported in part by sponsorships, advertising, and brand partnerships. You consent to the placement of your Episode, clips, and likeness in editorial and promotional contexts that may appear alongside, in proximity to, or in combination with sponsor messages, advertiser integrations, member promotions, mortgage and lending sponsors, brokerage sponsors, attorney and title sponsors, developer sponsors, event sponsors, and other commercial communications. This consent applies regardless of whether the sponsor or advertiser shares your industry, viewpoint, or business model. You waive any claim arising from the editorial or commercial proximity of your content to any sponsor or advertiser, except in cases where Real Estate Moguls expressly represents in writing that your content is a paid endorsement of a specific product or service, which Real Estate Moguls will not do without your separate written consent.
6. Editorial Control, Takedown, and Non-Disparagement
Real Estate Moguls retains complete editorial control over the Episode. We may remove, delay, modify, withhold, redact, demonetize, restrict, unpublish, re-edit, archive, or discontinue publication of any Episode or portion of an Episode at any time, for any legal, editorial, reputational, sponsorship, platform, regulatory, or business reason, without liability to you and without any obligation to publish or maintain publication of the Episode.
You agree not to publicly disparage Real Estate Moguls, its producers, hosts, members, sponsors, or advertisers through statements that are false, defamatory, that disclose confidential information about the production process or other guests, or that misrepresent the production experience. This provision does not prevent truthful statements made in good faith, statements protected by law, or participation in any government investigation or legal proceeding.
You agree to maintain the confidentiality of all pre-production materials, run-of-show documents, host preparation notes, other guests’ content shared in preparation, and any business information shared with you in the course of the production.
7. Professional Claims and Regulatory Compliance
You are solely responsible for ensuring that all statements, claims, credentials, testimonials, performance references, market commentary, licensing representations, brokerage references, lending statements, investment statements, tax statements, legal statements, and professional advice that you make during the Production Session comply with all applicable laws, rules, regulations, licensing obligations, brokerage policies, MLS rules, advertising rules, fair housing laws, the Real Estate Settlement Procedures Act (RESPA), the Truth in Lending Act (TILA), Securities and Exchange Commission rules, Financial Industry Regulatory Authority rules, state and federal advertising and endorsement rules, the National Association of Realtors Code of Ethics, state real estate licensing law, state lending and mortgage law, state bar rules of professional conduct, and any other applicable professional standards.
You confirm that any license, designation, certification, brokerage affiliation, employer, title, or company reference you state on camera is accurate as of the date of the Production Session. You confirm that any performance figure, sales volume, transaction count, market share claim, or testimonial you cite is truthful, current, properly substantiated, and presented in a manner that complies with the disclosure and substantiation requirements of your governing regulator.
Real Estate Moguls has no duty to verify, fact-check, or substantiate any statement, claim, credential, or testimonial you make. Editorial review by Real Estate Moguls is not a regulatory review and does not transfer compliance responsibility from you to us.
8. Assumption of Risk
Read this section carefully. By accepting this agreement you agree to assume risk of injury and property loss. You acknowledge that the Production Session takes place at a working media facility with active production equipment, cables, lighting, set elements, talent, crew, and the ordinary risks present at any media production or live venue. These risks include, without limitation:
- Tripping, slipping, falling, or other physical injury on or near the premises.
- Equipment hazards including hot lighting, electrical cables, rigging, sound equipment, and moving production gear.
- Exposure to others present at the facility and the ordinary health and safety risks of any indoor gathering.
- Reactions to set conditions including temperature, lighting intensity, sound levels, and the use of makeup or wardrobe.
- Loss, theft, or damage of personal property brought to the premises.
- Risks of travel to and from the production facility, including transportation, parking, and the surrounding area.
You assume all such risks knowingly and voluntarily, in the same way an attendee assumes risk when entering a stadium, theater, concert venue, or other live production environment. You arrive at the Production Session at your own risk and remain responsible for your own safety, conduct, and belongings while on the premises and on the surrounding property.
9. Release And Limitation Of Liability
Read this section carefully. By accepting this agreement you release real estate moguls from liability and agree to a cap on any recovery. To the fullest extent permitted by law, you release, waive, and discharge the Released Parties from any and all claims, demands, damages, losses, costs, expenses, and causes of action of every kind, whether known or unknown, whether arising in contract, tort, statute, or otherwise, arising out of or related to:
- Your attendance at, participation in, or travel to and from the Production Session.
- Any injury, illness, property damage, financial loss, or emotional distress you experience in connection with the Production Session.
- The recording, editing, release, modification, withholding, or non-release of the Episode, including any commentary, reaction, or republication it generates from third parties.
- Any act or omission of the Released Parties in connection with the production, except for conduct constituting gross negligence or willful misconduct, which is not waived to the extent the law prohibits waiver.
You agree that the total liability of the Released Parties to you, for any reason whatsoever, will not exceed one hundred United States dollars ($100). You waive any right to recover indirect, incidental, consequential, special, punitive, or exemplary damages from any Released Party, including lost profits, lost revenue, lost business opportunity, lost reputation, and emotional distress damages.
If a court of competent jurisdiction determines that the $100 cap is not enforceable for a particular claim, the Released Parties’ total liability for that claim is limited to the lowest amount permitted by applicable law for that category of claim. This Section is a complete bar to any claim that can be barred under applicable law. It survives the termination of this Agreement and the release or non-release of the Episode.
10. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from any third-party claim, demand, liability, judgment, settlement, fine, regulatory action, or expense, including reasonable attorney fees and costs, arising out of:
- Your acts or omissions during or in connection with the Production Session.
- Statements you make during the Production Session that infringe on a third party’s rights, defame a third party, violate any applicable law, or violate any professional or regulatory standard listed in Section 7.
- Your breach of any provision of this Agreement, the Universal Membership Agreement, or any representation or warranty you make in connection with the Production Session.
- Any injury or damage you cause to other guests, crew, premises, or equipment.
- Any regulatory investigation, complaint, or enforcement action arising from statements you make on camera.
Real Estate Moguls reserves the right to control the defense and settlement of any indemnified claim, at your cost, and you agree to cooperate in good faith with that defense.
11. Insurance Disclaimer
Real Estate Moguls does not provide and is not responsible for providing health insurance, accident insurance, disability insurance, property insurance, business interruption insurance, errors and omissions insurance, professional liability insurance, or any other insurance coverage for the Featured Guest. You are responsible for maintaining any insurance you determine appropriate for your participation in the Production Session, including any errors and omissions or professional liability coverage required by your governing regulator or brokerage.
12. Recording, Privacy, and AI-Assisted Processing
The Production Session is recorded in audio, video, and still photography. Recorded material is stored, edited, transcribed, indexed, archived, and used in the manner described in Section 4. Real Estate Moguls may use AI-assisted production tools for transcription, captioning, color correction, audio cleanup, search indexing, and editorial workflow.
Real Estate Moguls does not collect, store, or use biometric identifiers or biometric information as defined under the Illinois Biometric Information Privacy Act. Real Estate Moguls does not use facial recognition templates, voice-print identification, fingerprint or palm scans, retina or iris scans, or any system designed to identify individuals from biometric measurements. Standard audio and video recording for editorial production does not constitute the collection of biometric identifiers. If Real Estate Moguls ever introduces a feature that would collect biometric identifiers or biometric information, the Featured Guest will receive a separate, specific, written consent request before any such collection occurs.
You consent to the recording, storage, transcription, AI-assisted processing, and editorial use described in this Section.
13. Capacity and Authority
You confirm that you are at least eighteen years of age, that you are legally competent to enter into this Agreement, that you are signing it on your own behalf and not as an agent for another person unless you have separately disclosed and documented that agency relationship to Real Estate Moguls in writing, and that no other person or entity has the right to consent to or restrict your participation in the Production Session or the release of your likeness.
If any person under eighteen years of age appears in any Production Session, a separate parent or legal guardian release is required. This Agreement alone does not authorize the participation of any minor.
14. Adherence to the Universal Membership Agreement
You agree to the conduct, professionalism, and respect standards set out in the Real Estate Moguls Universal Membership Agreement, a copy of which is provided to you at booking and made part of this Agreement by reference. Where this Agreement and the Universal Membership Agreement overlap, both apply. Where they conflict, this Agreement controls for the limited purpose of your Production Session.
The applicable conduct standards include:
- Professional behavior at all times on the premises, on camera, and in the surrounding area.
- Respect for crew, hosts, fellow guests, and any other professionals present.
- Compliance with reasonable directions from the producer, host, and on-site staff regarding the production process, safety, and use of the premises.
- A drug-free and sobriety standard while on the premises. Alcohol is not present at recordings.
- Confidentiality of pre-production conversations, run-of-show materials, and other guests’ content shared in preparation.
- Honest representation of your credentials, license status, role, and the claims you make on camera.
We may end the Production Session at any time, at our sole discretion, if your conduct falls outside these standards. In that case, we may release, edit, or shelve the resulting material as we determine, and you remain bound by every other provision of this Agreement.
15. ARBITRATION, CLASS ACTION WAIVER, AND DISPUTE RESOLUTION
READ THIS SECTION CAREFULLY. BY ACCEPTING THIS AGREEMENT YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
The parties will first attempt to resolve any dispute through good-faith discussion between the Featured Guest and a Real Estate Moguls producer for at least thirty days following written notice of the dispute. If that does not resolve the dispute, the dispute is submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Cook County, Illinois, in the English language, before a single arbitrator. The arbitrator’s award is final and may be entered as a judgment in any court of competent jurisdiction.
If a court or arbitrator determines that the AAA Commercial Arbitration Rules do not apply to a particular Featured Guest because of the nature of the relationship or the characterization of the Featured Guest as a consumer, the parties agree that the AAA Consumer Arbitration Rules will apply in their place, and the arbitration will otherwise proceed on the terms set forth in this Section. Real Estate Moguls will pay the portion of arbitration filing and administrative fees that exceeds the comparable filing fee for a state court action in Cook County, Illinois.
Either party may bring a qualifying claim in small claims court in Cook County, Illinois, in lieu of arbitration, provided the claim remains in that court and is not removed or expanded beyond the small claims jurisdiction.
You waive any right to bring a claim as a plaintiff or class member in any class action, collective action, consolidated action, or representative proceeding. Any arbitration or court proceeding is conducted on an individual basis only. If a court determines that this class action waiver is unenforceable with respect to a particular claim, the remainder of this Section continues to apply, and the class claim proceeds in court rather than arbitration, with all other provisions of this Section preserved.
The prevailing party in any arbitration or court proceeding is entitled to recover its reasonable attorney fees and costs, except where a court or arbitrator determines that fee-shifting is unenforceable as to a particular claim, in which case each party bears its own fees for that claim and the remainder of this Section continues to apply.
16. Governing Law
This Agreement is governed by the laws of the State of Illinois, without regard to its conflict of laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois for any matter that proceeds in court rather than arbitration, including any action to enforce or vacate an arbitration award.
17. Severability and Survival
If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force. The court or arbitrator will modify the unenforceable provision to the minimum extent necessary to make it enforceable while preserving its intent. Sections 4, 5, 6, 7, 8, 9, 10, 11, 12, and 15 survive the termination of this Agreement and the release or non-release of the Episode.
18. Entire Agreement and Modification
This Agreement, together with the Universal Membership Agreement referenced in Section 14, contains the entire understanding between you and Real Estate Moguls regarding your Production Session and supersedes any prior or contemporaneous discussions, proposals, or agreements about the subject matter. No modification is binding unless made in writing and signed by both parties through the same acceptance workflow described in Section 2 or its written equivalent.
19. Acknowledgment
You acknowledge that you have read this Agreement in full, that you understand its terms including the assumption of risk, release of liability, indemnification, arbitration, class action waiver, professional claims, and likeness release provisions, that you have had the opportunity to seek independent legal advice, and that you are signing it freely and voluntarily through the acceptance workflow described in Section 2.
